WESH UK Other Services - Terms and Conditions
Provisioning of additional services (Web site Development)
All web site design, development, ecommerce and search engine optimisation work should be requested via our helpdesk in writing, giving you traceable progress 24 hrs a day of your requested services.
Consultations are provided without charge to the customer, but should a customer book a consultation and fail to turn up, without providing 24 hours notice, a £25 fee will be charged for our waiting and preparation time.
Assignment of contractors
At WESH UK we reserve the right to assign subcontractors to clients projects to insure the right fit for the job as well as on-time completion for the duration of any web site design agreement without additional un-authorised cost to our clients. Customers will never get an nasty bills for work not authorised.
Contractors (Freelance staff) may be assigned for such things as graphic design, logo and corporate branding, stationary design and creation and custom programming or scripting.
WESH UK will always use UK staff for our projects, and we never outsource work to any individuals or companies outside of the UK (unless specifically requested or chosen by the customer).
Contractors and freelance workers
Any contractors employed by WESH UK automatically forfeit all rights to display work carried out for us in their own portfolios and by accepting work from us, adhere to maintain the privacy of the customer, and that of WESH UK.
The rights to all work, designs, images and code, created for and on behalf of WESH UK will belong to WESH UK at all times.
Any contractor found to be in breech of this agreement with WESH UK will be charged all legal fee's plus damages which they accept responsibility for upon taking payment from us.
Taking payment for work provided by WESH UK means that you have read and understood this agreement and agree to adhere to our conditions mentioned above.
Copyrights and Trademarks.
Every customer represents to WESH UK and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to WESH UK for inclusion in Web pages are owned by the client, or that the client has permission from the rightful owner to use each of these elements.
Clients will hold harmless, protect, and defend WESH UK and its subcontractors from any claim arising from the use of such elements should they be in breach of any trademarks or copyright laws.
Copyright to Web Pages.
Copyright to the finished assembled work of all web pages, artwork, databases, copy and all other elements produced by WESH UK is owned by WESH UK until final payment of a client's bill. The client then takes ownership of the above mentioned elements contained in the finished assembled web site.
Rights to photos, graphics, source code, work-up files, and computer programs are specifically not transferred to the client, and remain the property of their respective owners.
WESH UK retain the right to display graphics and other web design elements as examples of their work in their respective portfolios.
Delivery of web site designs or projects
WESH UK will arrange with the client the most suitable method of delivery for work carried out on the clients behalf. Web site designs can be delivered either on Floppy disk, CD rom, Email or via web hosting and the delivery method will always be the customers preference.
The customer understands that WESH UK can provide web hosting at an extremely competitive cost to the client, but should the client provide services themselves they will require a separate contract with the web hosting Company of the clients choice which will meet the needs of the client's web site.
The client agrees to select an ISP which allows WESH UK full access to the web site and a cgi-bin directory via FTP and telnet and all email account setup's where applicable.
Web Design and Delivery Timescale's
WESH UK and the client must work together to complete a clients web site in a timely manner. We agree to work expeditiously to complete a clients web site within an acceptable time frame to the client and maintain it as and when requested by the client thereafter.
Timescale's for completion of web site designs and ecommerce stores will be estimated before work commence's and an overhang timeframe will be applied to allow for any problematic area's that may arise during the working period.
Client's may become ill, or their chosen web host may go down, lines or internet services may be disrupted by act's of nature or their product suppliers may cause them delays.
We appreciate that sometimes things do not always go according to plan and we will always do our utmost to work around any problems and complete our clients projects ASAP.
If for any reason our customers need to extend the timescale for web site development they agree to notify WESH UK by email to avoid delays, and to place there account on hold and avoid further charges due to lack of information to complete, preferably via our helpdesk.
